These terms govern your use of kavabarpartners.com and the Owner Diagnostic. The site is operated by CMM Prime LLC, a Florida limited liability company doing business as Kava Bar Partners (“Kava Bar Partners,” “we,” “us,” or “our”). By using the site, you agree to these terms. If you do not agree, do not use the site.
Who may use the site
This is a business-to-business site intended for people who are at least 18 years old. You may use its public content and diagnostic for your own lawful business evaluation.
Permitted use
Do not interfere with the site, attempt unauthorized access, introduce malicious code, use automated access that disrupts the service, or misrepresent Kava Bar Partners materials as your own services. You may print or save your own diagnostic result, but that permission does not grant a commercial resale or redistribution license.
Operational education only
The site provides general operational education, self-assessment tools, and descriptions of potential services. It does not provide legal, tax, accounting, investment, employment, food-safety, medical, health, architectural, engineering, brokerage, licensing, or regulatory advice. Obtain advice from appropriately qualified professionals for your circumstances.
No guarantees
Business performance depends on factors outside our control. Kava Bar Partners does not guarantee revenue, profit, financing, approvals, permits, opening dates, traffic, search rankings, valuation, expansion, or business survival. Diagnostic results depend on self-reported answers and are not an audit, valuation, compliance review, or prediction.
Intellectual property
Kava Bar Partners and its licensors retain their rights in the site, brand, operating-system descriptions, scorecards, templates, graphics, and original content. Except for normal personal business evaluation, no right to reproduce, modify, publish, sell, license, or create a competing product from that material is granted without written permission.
Third-party information
Links and references may lead to information controlled by others. We do not control its availability, accuracy, or policies. Review the original source and obtain qualified advice before relying on information that affects legal rights, health, safety, licensing, taxes, employment, financing, or construction.
Service engagements
Website use and email conversations do not create a client, partnership, joint-venture, fiduciary, franchise, employment, or advisory relationship. A service engagement begins only when CMM Prime LLC and the client sign a separate agreement or statement of work defining the scope, fees, responsibilities, confidentiality, intellectual property, data practices, and other applicable terms.
Site availability and disclaimers
We may change, suspend, or discontinue site features. To the fullest extent permitted by law, the site and its content are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.
Limitation of liability
To the fullest extent permitted by law, CMM Prime LLC and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, or business interruption arising from use of or inability to use this site. If liability cannot lawfully be excluded, the total liability arising from website use will not exceed $100. These limits do not apply where the law does not allow them.
Florida law
These website terms are governed by Florida law, without regard to conflict-of-law principles. Any dispute relating solely to website use must be brought in a court of competent jurisdiction in Florida, unless applicable law requires otherwise. If any provision is unenforceable, the remaining provisions remain in effect.
